What is the process?

Seeking Legal Advice

We always recommend that if you are considering creating or amending a will you should engage a solicitor to help you. A will is an important part of your estate planning and may have tax and other implications which it is important are properly addressed, particularly if you are changing the terms of an existing will.

If you do not already have a solicitor, you can find information about how to instruct one on the Law Society’s website here.

Benefitting the School

There are a number of different kinds of legacy that you could consider including in your will to benefit the School. More information about the options open to you is set out below.

Whatever kind of legacy you may decide to leave, it will be important that the School is properly identified in your will, so that your executors are able to clearly identify the School as a beneficiary and are able to get in touch with us.

Using the following details will ensure that the School is properly identified:

The Fulham Boys School School Foundation, 532 Fulham Road, London, SW6 5BD

Registered charity number 1197150

Can I leave my gift to the School for a specific purpose?

Yes, you can. The Fulham Boys School Foundation is raising funds for its work in four core areas:

  • Smaller Class sizes
  • Our co-curricular programme
  • Our enterprise programme
  • Recruitment and retention of great teachers

We also welcome legacies to support our students with access to bursaries for university support – be this buying resources, setting up home or support with fees.

Additionally, we operate a support fund for existing students and their families in need of financial help and assistance.

You may of course have your own preference; we would be happy to discuss this with you.

Please do note that legacies given for very narrow or restricted purposes need careful consideration. Any legacy left to the School for a specific purpose will of course be used by the School only for that

purpose, but if this is very specific its value to the School and its pupils may be restricted in practice, particularly as the School will continue to grow and develop over time.

You may therefore prefer to leave a legacy to support the general purposes of the School, which would enable us to apply your legacy in the way we decide will benefit the School and its pupils at the time of receipt.

We have suggested a form of words for an “unrestricted” legacy of this kind, which you can discuss with your solicitor.

How do I include a legacy in my will?

We have prepared some examples of the kind of provisions that might be used in order to help you consider what kind of legacy you may like to leave to the School and to assist you in your discussions with your solicitor, who can advise you on how they can best be incorporated into your will:

Unrestricted residuary legacy

If you are considering leaving the School a share or proportion of your estate which can be used by the School for its general charitable purposes, then a provision of the following kind may be appropriate:

I give [number]% of the residue of my estate (before the deduction of inheritance tax if any is payable) to The Fulham Boys School Foundation, 532 Fulham Road, London, SW6 5BD Registered charity number 1159542 (“The school”) for the general charitable purposes of the School.

The value of a legacy of this kind will vary depending upon the value of your estate. This approach will however ensure that other beneficiaries of your estate will receive a proportionate share of whatever your estate is worth on your death.

Unrestricted pecuniary legacy

If you are considering leaving the School a legacy of a fixed amount out of your estate which can be used by the School for its general charitable purposes, then a provision of the following kind may be appropriate:

I give the sum of £ [amount in numbers and words] free of tax to The Fulham Boys School Foundation, 532 Fulham Road, London, SW6 5BD Registered charity number 1159542 (“The school”) for the general charitable purposes of the School.

Unlike a residuary legacy, the value of a legacy of this kind will obviously not vary depending upon the value of your estate, so may have an effect on value received by the beneficiaries of the residue of your estate.

It may also be affected by inflation over time. It would be possible to add a proviso to a legacy of this kind in order to help protect your legacy to the School from being adversely affected by inflation:

My gift shall be index-linked, so that the actual amount given shall be found by dividing the gift by the Retail Prices Index (“RPI”) figure for the month in which this Will is executed and multiplying the result by the RPI figure for the month in which I die.

Restricting a legacy for a particular purpose

You may decide that either kind of legacy (whether of a specified share in your estate or of a fixed amount) should be applied by the School for a particular purpose, in which case the following provision may be appropriate:

I give [for a residuary legacy:[xx]% of the residue of my estate (before the deduction of inheritance tax if any is payable)] or [for a pecuniary legacy: the sum of £[amount in numbers and words] free of tax] to The Fulham Boys School Foundation, 532 Fulham Road, London, SW6 5BD Registered charity number 1159542 (“The School”) to be applied by the School [e.g. to provide grants, bursaries and other forms of financial assistance to pupils and prospective pupils of the School who are in need by reason of financial hardship].

If you are thinking of leaving a restricted legacy of this kind please can we ask that, if you are happy to do so, you get in touch with us so that we can discuss how best to help achieve your aims.

Specific legacies

You may decide that you would like to leave the School a“specific legacy”. You should discuss with your solicitor how best to provide for this in your will. If you are thinking about leaving the school a specific legacy of this kind, we ask that, if you are happy to do so, you get in touch with us so that we can discuss how best to help achieve your aims.

Endowment Funds

It would be possible for your legacy to be used to create an “endowment fund” where the School is only permitted to invest the capital amount of your legacy and spend the income it generates. Such legacies are of course very gratefully received by the School, but do not always enable us to use them as effectively as possible. Again, if you are considering leaving a legacy of this kind we ask that, if you are happy to do so, you get in touch with us so that we can discuss how best to help achieve your aims.

Contact Us

We are always pleased to provide more information about our legacy programme and the work that we can do as a result of the legacies the School receives. Our legacies are administered through The Fulham Boys School Foundation which has a Board of Trustees with representation independent from The Fulham Boys School.

Should you wish to speak to us with regard to a legacy, please contact Mark Harris, Head of Finance & Operations,
